Wyeth announced today that the jury deliberating in the cases of Lorraine Gordon v. Wyeth, Sonia Jones v. Wyeth, and Susan Rives v. Wyeth rendered a decision in favor of the plaintiffs in the second, liability phase of this bifurcated (two-phase) trial. The jury determined that Wyeth is liable for the $2,500,000 in compensatory damages previously determined in phase one of the trial. Ms. Gordon was awarded $750,000, Ms. Jones $500,000 and Ms. Rives $1,250,000. Wyeth will pursue post-trial motions and, if necessary, will appeal the verdicts.
The verdicts came at the end of the second phase of the trial that began on December 27, 2004 before The Honorable Alfred J. DiBona in the Court of Common Pleas of the First Judicial District of Pennsylvania. As previously announced by Wyeth in a press release, phase one of the trial was completed on December 22, 2004.
